Agreement for Release of Liability, Assumption of Risk, and Indemnification

In consideration of Travis County (the “County”) allowing the undersigned individual (“I” or “me”) to
participate in the County’s volunteer program, I hereby agree as follows:

1. I understand and agree that I am volunteering solely for personal purposes, without any promise or expectation of compensation, fees, benefits, or future employment with the County, and without any liability of any nature on behalf of the County. I further agree that all services are performed at my own risk.
2. I understand that my participation in the County’s volunteer program may involve risk of physical injury to me or others, damage to my property, or other consequences, which might result from my own actions and/or the actions, inactions, or negligence of others, the conditions of the premises, weather conditions, or conditions of any equipment used for the County’s volunteer
   program. These risks include, but are not limited to: tripping, falling, scraping, bruising, animal bites or scratches, and exposure or contact with poisonous plants. There may also be other risks not known or reasonably foreseeable. I certify that I understand and appreciate the nature of these risks.
3. I HEREBY RELEASE AND AGREE TO AND SHALL INDEMNIFY, SAVE AND HOLD
   HARMLESS AND DEFEND THE COUNTY AND ITS OFFICIALS, AGENTS, AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, INJURIES, COSTS (INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES AND LITIGATION EXPENSES), DAMAGES, DEMANDS, SUITS, CAUSES OF ACTION, OR LIABILITY OF ANY KIND, FOR INJURY TO OR DEATH OF ANY PERSON, OR FOR DAMAGE TO ANY PROPERTY, THAT MAY ARISE OUT OF OR IN CONNECTION WITH MY PARTICIPATION IN THE COUNTY’S VOLUNTEER PROGRAM OR THE COUNTY’S USE OF MY NAME, IMAGE, OR LIKENESS AS DESCRIBED HEREIN.
4. I agree that all information, property, and materials received and/or created by me in connection with performance of my volunteer work are property of the County, and I will return them promptly upon request or termination of my service.
5. I understand that while participating in the County’s volunteer program, I will not be an agent, servant, or employee of the County and therefore will not be covered by the County for any
   health, workers compensation, death, or disability benefits.
6. I understand that County staff may, at any time and for any reason, make changes in my assignment or terminate my participation in the County’s volunteer program.
7. I understand that I may decide to sever my participation in the County’s volunteer program at any time.
8. I understand and agree to abide by the policies and procedures of the County relating to the performance of duties and responsibilities assigned to me. I further agree to obey the direction and commands of County staff regarding my volunteer activities and acknowledge that any disregard of the directions, restrictions, rules, or regulations referenced herein shall be grounds for immediate termination of my participation in the County’s volunteer program.
9. I understand and agree that, in the course of my participation as a volunteer with the County, I may have access to keys, combinations, or other information that are confidential because of security concerns. I understand and acknowledge that I will not disclose this information or any other security related information to any person. I understand that my volunteer status will be
   terminated if I make improper disclosure of this or any other security-related information.
10. I authorize the taking of photographs and video and audio recordings of me during my volunteer activities. I hereby grant and convey to the County all right, title, and interest in any and all photographs, images, video, and audio recordings taken of me during my volunteer activities with the County, including, but not limited to any royalties, donations, proceeds, or benefits derived from such photographs, images, or recordings. I fully consent and authorize the County to use, without compensation or further notice to me, my name, likeness, image, voice, and biographical data for any public purpose, including digital and print publications used within County departments or shared with members of the public.
11. I certify that I have adequate insurance to cover any injury or damage I may suffer while participating or else agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I have.
12. I agree to release Travis County, its officers, agents, employees, and servants from any claim whatsoever on account of first aid or medical treatment rendered to me in connection with my volunteer activities with the County.
13. I understand and agree that this Waiver Agreement will be governed under the laws of the State of Texas, and venue for any dispute related to this Waiver Agreement will be in the appropriate court in Austin, Travis County, Texas.
14. I agree that this release, waiver, and covenant not to sue is intended to be as broad and inclusive as permitted by the laws of the State of Texas and that if any portion of this agreement is held invalid, I agree that the balance shall, notwithstanding, continue in full legal force and effect.

I certify that I am the parent/guardian with legal responsibility for the above-named volunteer (“Minor Volunteer”). Minor Volunteer is under 18 years of age. In consideration of Travis County (the “County”) allowing Minor Volunteer to participate in the County’s volunteer program, the undersigned individual (“I” or “me”) hereby agrees
as follows:

I understand that Minor Volunteer’s participation in the County’s volunteer program may involve risk of physical injury to Minor Volunteer or others, damage to Minor Volunteer’s property, or other consequences, which might result from Minor Volunteer’s own actions and/or the actions, inactions, or negligence of others, the conditions of the premises, weather conditions, or conditions of any equipment used for the County’s volunteer program. These risks include, but are not limited to: tripping, falling, scraping, bruising, animal bites or scratches, and exposure or contact with poisonous plants. There may also be other risks not known or reasonably foreseeable. I certify that I understand and appreciate the nature of these risks.

4. I agree that all information, property, and materials received and/or created by Minor Volunteer in connection with Minor Volunteer’s performance of volunteer work are property of the County, and I will ensure that Minor Volunteer will return them promptly upon request or termination of Minor Volunteer’s service.
5. I understand that while participating in the County’s volunteer program, Minor Volunteer will not be an agent, servant, or employee of the County and therefore will not be covered by the County for any health, workers compensation, death, or disability benefits.
6. I understand that County staff may, at any time and for any reason, make changes in Minor Volunteer’s assignment or terminate Minor Volunteer’s participation in the County’s volunteer program.
7. I understand that I may decide to sever Minor Volunteer’s participation in the County’s volunteer program at any time.
8. I understand and agree that Minor Volunteer must abide by the policies and procedures of the County relating to the performance of duties and responsibilities assigned to Minor Volunteer. I further agree that Minor Volunteer must obey the direction and commands of County staff regarding Minor Volunteer’s participation in the County’s volunteer program and acknowledge that any disregard of the directions, restrictions, rules, or regulations referenced herein shall be grounds for immediate termination of Minor Volunteer’s participation in the County’s volunteer program.
9. I authorize the taking of photographs and video and audio recordings of Minor Volunteer during Minor Volunteer’s participation in the County’s volunteer program.
